TERMS AND CONDITIONS FOR ONLINE CREDIT CARD PAYMENTS

 

These terms and conditions (“Payment Terms”) apply to any payment you make online to NO-DES, Inc. (“NO-DES”) using a credit card.  As used in these Payment Terms, “You” and “Your” refer to the person giving this consent and to any person or organization you are making the online payment on behalf of.  By authorizing payment to NO-DES using a credit card online, You are accepting and agreeing to these Payment Terms.

 

Order Cancellation & Return Policy

 

ALL SALES ARE FINAL.  Orders cannot be cancelled once they have been accepted by NO-DES.  NO-DES will only accept returns for refund or exchange if the goods You receive are non-conforming, damaged, or are otherwise defective.  In the event You receive goods that are non-conforming, damaged or defective, You must first contact NO-DES within thirty (30) days of Your purchase to obtain a return merchandise authorization number (“RMA Number”).  Any returns initiated after said thirty (30) day period, or without first contacting NO-DES, will be denied.  If Your return is approved, NO-DES will provide detailed shipping instructions for sending the goods back.  All boxes returned to NO-DES must be packaged to prevent any further damage during transit and clearly labeled with the RMA Number.  After NO-DES has evaluated the returned products and confirmed them to be non-conforming, damaged and/or defective, an offer of replacement will be given to You. In some cases, a credit may be offered in NO-DES’ sole discretion. If the returned goods are determined by NO-DES to be conforming and not damaged/defective, they will be returned to You at Your expense.

 

Payment Authorization

 

NO-DES accepts the following credit cards for payment of invoices that are less than $10,000.00: (i) American Express; (ii) MasterCard; (iii) Visa; and (iv) Discover.  NO-DES does not accept payment by credit cards for charges in excess of $10,000.00 and reserves the right in their sole discretion to accept or decline any credit card for any reason.

 

Each time You authorize an online payment to NO-DES using a credit card, You are representing, warranting, and confirming that:

 

  • You are over 18 years of age;

  • You have the appropriate authority to accept and agree to these Payment Terms on behalf of the individual or organization You are making the payment for;

  • The credit card is issued in Your name or You are otherwise authorized to make payments using the credit card;

  • The information supplied by You in processing Your online payment is correct, accurate and complete;

  • There are sufficient funds and/or sufficient credit available on the credit card account at the time You authorize payment for processing to fund the payment in full; and

  • You will pay the credit card issuer all charges incurred

 

You are responsible for any charges or fees assessed against the credit card by the card issuer or any other third party as a result of making the online payment.

 

Processing of Payment

 

The credit card information You supply at the time of making Your online payment is processed by NO-DES’ payment service provider (“Payment Processor”).  NO-DES does not retain or otherwise digitally store any information concerning Your credit card.  The Payment Processor, however, may retain information concerning You and Your credit card.  Use of the information by the Payment Processor is governed by the Payment Processor’s privacy policy.  By making an online payment, You acknowledge that You have reviewed all of the Payment Processor’s terms and conditions, including its Privacy Policy, and agree to be bound by them.

 

Payments will be processed through the Payment Processor’s secure website.  Notwithstanding, by using the online payment service You acknowledge that Your personal information, including without limitation credit card information, is being transmitted over the Internet and may therefore be susceptible to interception, misuse, hacking, theft and/or fraud.

 

You will receive a confirmation notice if Your online payment is successful.  If Your online payment is declined, You will be advised that Your payment has failed.  NO-DES is not advised by the Payment Processor or Your credit card provider as to why a payment has been declined.  It is therefore recommended that You contact Your credit card provider for more details.  If Your online payment has been declined, You are responsible for making timely payment on Your invoice using another payment method.

 

Limitations on Liability and Exclusion of Warranties

 

UNDER NO CIRCUMSTANCES SHALL NO-DES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING PUNITIVE OR EXEMPLARY, WHICH ARISE OUT OF OR IN ANY WAY CONNECTED WITH THE ONLINE PROCESSING OF PAYMENTS, INCLUDING, WITHOUT LIMITATION, ANY LOSS OR DAMAGES SUFFERED AS THE RESULT OF THE UNAUTHORIZED ACCESS OR ALTERATION OF TRANSMISSIONS OF DATA.

 

NO-DES DOES NOT MAKE ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO PROCESSING OF PAYMENTS UNDER THESE PAYMENT TERMS.

 

Amendment and Cancellation of Payment Terms

 

NO-DES may amend these Payment Terms at any time without giving prior notice. Any amendment applies to payments and transactions that occur after the date the amendment is effective. NO-DES may change, suspend, or terminate the availability or features of online payments at any time, without prior notice.

Governing Law

 

These Payment Terms will be governed by the law of the state of New Mexico without regard to choice or conflicts of law provisions.

 

Your Agreement.

 

BY CLICKING FORWARD TO MAKE A PAYMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE PAYMENT TERMS AND YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH ABOVE AND ANY FUTURE AMENDMENTS TO THIS AGREEMENT WHICH MAY BE MADE FROM TIME TO TIME.
